Agreement and scope

These Terms govern your access to and use of the SupaFan.to services, including the public website, creator app, admin tools, and any paid features (collectively, the “Service”). By creating an account, clicking “I agree,” or otherwise using the Service, you enter into a binding agreement with Mind Vault Associates (Yksityinen elinkeinonharjoittaja, VAT ID FI32250653) (“we,” “us,” “our”).

If you do not agree, do not use the Service.

Eligibility and age

You must be at least 13 to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian who is responsible for your use and agrees to these Terms on your behalf.

We do not knowingly permit children under 13 to use the Service. If we learn that we collected personal information from a child under 13 in a manner that requires parental consent, we will take steps to delete it.

Accounts and security

You are responsible for safeguarding your account and for activities that occur under your account. You agree to provide accurate information and to keep it current. You must promptly notify us at support@supafan.to of any suspected unauthorized access.

Creator profiles and public visibility

If you publish a creator profile, you understand that profile content you choose to publish may be publicly visible. You control what you publish.

You may include links to third-party websites and embed third-party content. Those third parties’ terms and privacy practices govern their services.

User content, ownership, and licenses

You retain ownership of content you submit to the Service (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content solely as necessary to operate and provide the Service, including making public profile content available to visitors.

You represent that you have all rights needed to submit your User Content and that your User Content does not violate law or the rights of others.

Acceptable Use

Your use of the Service must comply with these Terms and the Acceptable Use Policy, which is incorporated by reference. Violations may result in content removal, account restriction, suspension, or termination.

If the Service enables paid interactions (for example, a “Support Message”), additional Payment Terms apply.

  • Pricing and fees: The Service will display the price and any platform fee before purchase.
  • Delivery: Delivery means that after the customer submits the message fields on Stripe and completes payment, the customer’s email address and the submitted message become visible to the merchant (SupaFan.to user) inside the SupaFan.to system under that user’s account. Delivery does not include any reply by the merchant to the customer. (Example: “A Support Message is delivered when payment is confirmed and the message becomes available to the creator within the creator inbox.”)
  • No promise of reply: Creators may reply but are not required to do so, and we do not guarantee replies.
  • Refunds: Refund rules are described in the Refund Policy and Payment Terms. Where consumer law requires a withdrawal right (or exceptions), we will comply and will use an explicit waiver flow when applicable.

Moderation, enforcement, and reporting

We may provide user reporting mechanisms. We may investigate and take action on reported content, accounts, or transactions.

We are not obligated to monitor all content. Where required, we will maintain notice-and-action mechanisms and provide users with a way to report illegal or harmful content.

Intellectual property complaints

We respond to copyright and other IP complaints in accordance with the Copyright and IP Policy (including DMCA procedures for U.S. notices).

Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if required for safety, compliance, or legal reasons. Certain terms survive termination (for example, IP provisions, liability limitations, indemnity, and dispute resolution).

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) USD $100 OR (B) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability will be limited to the maximum extent permitted by law.

Indemnity

You agree to indemnify and hold us harmless from claims arising out of your User Content, your use of the Service, or your violation of these Terms.

Governing law and disputes

These Terms are governed by Finland (Finnish law), with mandatory EU consumer and data protection laws where applicable, excluding conflict-of-law rules. Exclusive venue is District Court of Southwest Finland (Varsinais-Suomen käräjäoikeus), Turku, Finland, unless mandatory consumer law provides otherwise.

Changes

We may update these Terms. We will update the “Last updated” date and, where changes materially affect your rights, provide additional notice. Continued use after the effective date constitutes acceptance.
